Private Drive Access
Policy:To establish a policy to identify ownership to correct pavement deterioration issues where private access meets public streets.
Procedures:"Public streets" shall mean street pavements, curb and gutters, and other related items that are owned by a political subdivision or public utility.
"Private Drive" shall mean streets, curb and gutters, driveway approaches, ribbons, and other related items that are owned by a private property owner and not accepted by the city for perpetual maintenance.
Transitions from public streets to private drives will be made with a concrete delineation. The concrete delineation may be a driveway approach, valley gutter or concrete apron. The concrete delineation must be constructed in accordance with the Design and Construction Manual. The concrete delineation will be considered private property and will be maintained by the property owner.
The City will maintain the public street from the back edge of curb to back edge of curb. In the absence of a back of curb in the case of a constructed driveway approach, the city will determine the limits of maintenance responsibility by extending the back of curb line as if the private drive was not present. Roadways that do not have curb and gutter will be maintained from edge of pavement to edge of pavement. The city will at its expense repair or replace damaged or deteriorated asphalt or concrete within these limits
The property owner may seek reimbursement from the city for any concrete or asphalt replacement that takes place within the above mentioned limits of a public street. The City will reimburse the property owner the unit price of placed materials based on the City's current on-call contract. Reimbursement will require the following steps:
1. The property owner must contact the City for approval
2. The property owner must notify the One Call system
3. All required permits must be obtained
4. Specifications in the Design and Construction Manual must be met
5. All work must be inspected and approved
