205 CALL OUT DUTY (Effective 03/07/2022)

205.1 Required Call Out

As determined by the employee’s supervisor, an employee may be required to work during the employee’s unscheduled off-duty hours (“Call Out”). Employees who refuse to report for a Call Out may be subject to disciplinary action. Employees must be fit for duty when reporting for Call Out duty and while working. Each department shall determine the required response times and the method and order in which employees will be chosen for Call Out duty

205.2 Pay for Call Out

A non-exempt employee who is required to work during a Call Out will be paid for the actual hours worked or four (4) hours, whichever is greater, except as set forth in Section 205.3. A non-exempt employee shall be paid at 1.5 times the employee’s regular rate of pay. If an employee receives shift differential pay at the time of the Call Out, the employee’s regular rate of pay shall include the appropriate shift differential regardless of the number of calls received during the Call Out.

Non-exempt employees who are required to work (i) hours immediately before or after the employee’s normal workday, or (ii) pre-scheduled overtime scheduled at least one workday or shift beforehand are not eligible for Call Out pay.

An exempt employee who is required to work during a Call Out will be paid for the actual hours he/she works at his/her regular hourly rate of pay.

205.3 Pay for Off Duty Supervisors

If an employee in the Department of Public Works, Department of Water Utilities, or Information Technology is scheduled as the "Off Duty Supervisor," the employee will receive stipend pay pursuant to a department policy approved by the Department of Human Resources and the City Manager.

Non-exempt employees who receive stipend pay pursuant to this Section shall only be paid for the actual hours worked at the employee’s regular rate of pay or overtime rate, as may be applicable, during such time the stipend is provided. When the stipend is not provided, such employees shall be paid actual hours worked or four (4) hours, whichever is greater.
